Man Indicted on 10 Counts in Attack on Elderly Oconee Woman
Jacob Potter Wagner has been formally charged with criminal attempt to commit murder. Criminal indictments are not evidence of guilt; they are only charges. Defendants are presumed innocent unless proven guilty.

An Oconee County grand jury handed down a ten-count indictment against the Rays Church Road resident that also includes two counts of aggravated battery, two counts of aggravated assault, three counts of burglary and one count theft by taking. The indictment was filed with the Oconee County Clerk of Superior Court on May 30.
The indictment alleges Wagner "did strike Judith Gilvey, a person over the age of 65, repeatedly about the head and face with his fists and hands and with a certain object, which object is not presently known to the Grand Jury." It was an attack so brutal that she lost an eye, according to the document.

Authorities said Wagner worked for Gilvey and the two had had a dispute over money one day before the alleged attack at the Peacock Drive home on May 10.
Wagner is presently behind bars at the. reported this week that bond has been set, but, according to the article, Wagner's defense attorney said it is unlikely he'll find the resources to post the $150,000.

The Walton County Sheriff's Office has also placed a probation hold on Wagner.
